A Resolution Authorizing a Contract for Painting and Maintenance of the Cedar Lane Water Tower with Jetco, Ltd. of Wauconda, Illinois

              Section 1.                Recitals

              The Village of Northbrook’s 500,000 gallon water tower (“Cedar Tower“) located behind the Village hall on Cedar Lane was constructed in 1954 by Chicago Bridge and Iron. Painting of the exterior and interior of the Cedar Tower was included in the FY 19/20 Budget (the “Project”). Staff worked with a consulting engineer (Christopher B. Burke Engineering, Ltd.) to review the tower, develop the scope of work, and prepare the specifications which included several alternate bid items. A bid for the Project was released on October 10, 2019 and four bids were received on October 30, 2019. Jetco, Ltd. of Wauconda, Illinois (“Painting Contractor”) submitted the lowest responsive and responsible bid in the amount of $443,498 for the base scope of work. In reviewing the bids staff identified replacement of the cathodic protection system ($21,370) and painting of a logo or slogan on the Cedar Tower ($5,000) as alternate items that should be included in the awarded scope of work.


              The Village’s Fiscal Year 2019/20 Budget provides sufficient funds in Account No. 21-4180-727 for this work.  Based on these factors, Village staff recommends authorizing the execution of an agreement for the Project with the Painting Contractor in the amount of $443,498 for the base scope of work and $26,370 for the alternate items for a total contract amount of $469,868 (“Contract”). A contingency in the amount of $23,400 is also requested to cover any work associated with unforeseen conditions.


              The President and the Board of Trustees have considered the Contract and determined that it is in the best interests of the Village and the public to enter into the Contract.

              Section 2.              Approval of Agreement.


              The Contract with the Painting Contractor is approved in a form acceptable to the Village Manager and the Village Attorney.

Section 3.              Authorization to Execute Agreement.

The Village Manager is hereby authorized and directed to execute and seal, on behalf of the Village, the Contract only after receipt by the Village Clerk of at least three original copies of the Contract executed by the Painting Contractor and compliance by the Painting Contractor with all conditions precedent to closing; provided, however, that if such executed copies of the Contract are not received by the Village Clerk within 60 days after the date of adoption of this Resolution, then this authority to execute and seal shall, at the option of the President and Board of Trustees, be null and void.


Section 4               Authorization to Execute Change Orders.


The Village Manager is authorized to execute one or more change orders for additional work consisting of additional unforeseen items of work related to, or arising from other work contemplated by, the scope of work in the Contract in an amount not to exceed $23,400, subject to the Village Manager making the necessary determination that the work contemplated by the change order complies with Section 33E-9 of Article 33E of the Criminal Code of 1961 and placing a copy of such determinations in the file.
